What the law says about abortion in uae
Abortions are not legal for any reason in the UAE. They are only allowed under certain strictly defined conditions.
The main law governing this is the Federal Decree Law No 4 of 2016 on Medical Liability.
In 2024 the government issued the Cabinet Resolution No 44 of 2024 effective 21 June 2024 which expanded the situations in which abortion is allowed.
The allowed cases
Under the new 2024 resolution abortion may be legally performed if some or all of these conditions are met
The pregnancy puts the life of the woman in danger. The foetus has a serious deformity or condition making life outside the womb impossible or severely impaired.
The pregnancy is the result of intercourse without the womans consent such as rape.
The pregnancy is the result of incest the person who impregnated the woman is a relative with whom marriage is permanently unlawful.
The pregnancy is terminated with the request of both spouses after approval by a designated medical committee.
Key conditions and restrictions
The procedure must be done in a licensed health facility and by the type of specialist doctor authorised under UAE law.
The pregnancy must not have exceeded 120 days about four months at the time of abortion under the 2024 law. If the woman is a non‑citizen (expat), she must hold a valid UAE residence permit and in many cases have been resident for at least 1 year before requesting an abortion.
The womans informed written consent is required. If she is unable to consent, then consent of her husband or guardian may be required, except in emergencies.
There must be no risk of medical complications that would endanger the womans life in performing the procedure.
What this means in practice
In plain terms yes abortion is legal in the UAE but only in specific limited circumstances, and with a number of strict conditions.
If a pregnancy is purely unwanted for social or economic reasons without any of the allowed grounds above then abortion is not legally permitted.
